Yip Yap Terms and Conditions

Welcome to Yip Yap, a chat app for communities operated by Second Coffee, LLC ("we," "us," or "our"). By accessing or using the Yip Yap mobile application and related services (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Service.

1. Acceptance of Terms

By using Yip Yap, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree to these Terms, please do not use the Service.

2. Eligibility

You must be at least 13 years old to use Yip Yap. By using the Service, you represent and warrant that you meet this age requirement.

3. Service Availability

Yip Yap is currently available in the United States, Europe, and South America. We reserve the right to modify the availability of the Service at any time.

4. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
• Account deletion process is outlined in our Privacy Policy.

5. User Content

• Yip Yap allows users to upload text, images, and other content ("User Content") within private communities.
• You retain all ownership rights to your User Content. However, by uploading User Content, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, modify, publicly perform, publicly display, reproduce, and distribute such User Content on and through the Service.
• You are solely responsible for your User Content and the consequences of posting or publishing it.
• We reserve the right to remove any User Content that violates these Terms or that we find objectionable for any reason, without prior notice.

6. Prohibited Content and Activities

You agree not to post, upload, or share any content that:

• Is illegal, pornographic, or violates any applicable laws or regulations.
• Infringes on the intellectual property rights of others.
• Is harmful, abusive, defamatory, or otherwise objectionable.
• Contains viruses, malware, or any other malicious code.
• Violates the privacy or publicity rights of others.

7. Content Moderation

• Yip Yap provides content moderation through software and community moderators.
• Users can report inappropriate content by contacting moderators through the app.
• We reserve the right to remove any content that violates these Terms or that we deem inappropriate, without prior notice.

8. Intellectual Property

• The Service and its original content, features, and functionality are owned by Second Coffee, LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
• You may not copy, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as incidental to normal web browsing or mobile app usage.

9. Privacy and Data Collection

• Our Privacy Policy explains how we collect, use, and share your personal information. By using Yip Yap, you agree to our collection and use of information as described in the Privacy Policy.
• We use Google Analytics to collect and analyze usage data.
• In the future, we may collect location data to help users find nearby communities. Users will be notified and asked for permission before such features are implemented.

Yip Yap may contain links to third-party websites or services that are not owned or controlled by Second Coffee, LLC. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

We reserve the right to terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.

To the maximum extent permitted by law, Second Coffee, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use or inability to use the Service.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. We will notify you of any changes via email.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
